Acceptance of terms

By accessing or using Art Scout ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of the Service

Art Scout is an online marketplace that helps clients and artists connect around creative projects. We provide tools to create and discover project listings, build artist profiles and portfolios, submit and manage applications, communicate with other users, and use other marketplace features made available through the Service.

Eligibility

You must be at least 18 years old to create an account and use the Service. By registering, you confirm that you meet this age requirement.

Your account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for activity that occurs through your account.
  • You must provide accurate and truthful information when registering, creating a profile or portfolio, posting a project, or applying to a project.
  • You must notify us promptly if you suspect unauthorized access to your account.

Acceptable use

You agree not to:

  • Post false, misleading, fraudulent, or deceptive information about yourself, your work, a project, an application, or another marketplace interaction.
  • Misrepresent the authorship, origin, ownership, or rights associated with artwork or other content you upload or display.
  • Present AI-generated artwork as human-created artwork. Art Scout is a human-artist marketplace, and doing so will result in a permanent ban from the Service.
  • Harass, abuse, threaten, exploit, or harm other users.
  • Use the Service for an unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service or another user's account.
  • Scrape, copy, or redistribute content from the Service without our written permission, except as permitted by law.
  • Use the Service to send unsolicited commercial messages or spam.

User content

You retain ownership of content you post on Art Scout, including profile information, portfolio images and descriptions, project listings, application content, messages, and reviews. By submitting content, you grant us a non-exclusive, worldwide license to host, store, display, reproduce, and distribute that content as reasonably necessary to operate, secure, and provide the Service. You are responsible for the accuracy and legality of content you submit and for having the rights necessary to upload and display it.

Marketplace relationship and user responsibility

Art Scout provides a platform for clients and artists to find and communicate with one another. We do not guarantee or independently verify the identity, qualifications, experience, ownership claims, licensing, insurance, originality, or suitability of every user, portfolio item, or project listing. Users are responsible for evaluating one another, confirming project scope, compensation, deadlines, usage rights, licensing terms, delivery requirements, and other conditions before entering into an agreement or beginning work.

Payments and paid features

Art Scout may offer paid platform features. Unless a feature expressly states otherwise, payments made for platform features are payments to Art Scout for use of that feature and are separate from compensation or payments agreed between clients and artists. Payment processing may be provided by a third-party payment provider.

Intellectual property

Software, design, logos, and content created by or for Art Scout are owned by us or licensed to us and are protected by applicable intellectual-property laws. You may not reproduce, distribute, or create derivative works from our protected content except with permission or as otherwise permitted by law.

Suspension and termination

We may suspend or terminate access to the Service when we reasonably believe these Terms have been violated, when necessary to protect users or the Service, or when required by law. You may request closure of your account through available account controls or by contacting [email protected]. Certain records may be retained where permitted or required for legal, security, fraud-prevention, transaction, or dispute-resolution purposes.

Limitation of liability

To the maximum extent permitted by applicable law, Art Scout shall not be liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. To the maximum extent permitted by law, our total liability to you for a claim arising from the Service shall not exceed the amount you paid us, if any, in the 12 months preceding the event giving rise to the claim.

Governing law

These Terms of Service are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Any venue or jurisdiction requirements remain subject to applicable law.

Changes to these terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "last updated" date. Where required, we will provide additional notice of material changes. Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
